Real Estate
At Allen, Wertz & Feldman, LLP, we represent clients in four major areas of real estate law.  Those areas are acquisitions, real property financing, condominium and homeowner associations, and leasing and land use.

Acquisitions
The Colorado real estate market is significant to say the least.  We assist clients with all aspects of acquiring and selling all types of residential and commercial real estate.  Negotiation, review of title and documentation of the acquisition are the primary functions of a real estate attorney.  We strive to professionally assist clients with complex and basic issues. Whether the property is a small condo or a large commercial building with dozens of existing tenants, we work closely with our clients to ensure that expectations are met, on time and on budget.

Real Estate Financing
We have experience in a variety of real estate financing matters including construction loans, permanent loans, oversight of construction administration, all the way to complex governmental underwritten and subsidized housing developments financed with individual tax credits.  The majority of our practice in this area involves assisting clients with financing construction of resort community homes.  However, we have spent a considerable amount of time in the public trustee and judicial foreclosure business, and we are well advised in those matters as well.

Condominium
We assist condominium associations and unit owners with all aspects of condominium law including, covenants and restrictions, collection of maintenance assessments with condominium liens and foreclosures and declarations of condominium for both new developments and condominium conversions.

Leasing and Tenancies
We have a great deal of experience in all aspects of commercial and residential leasing, representing landlords and tenants constantly for the past six years.  We can assist with negotiating and drafting leases that focus on purposeful provisions that are clear.  We are big advocates of practicing law in the English language, instead of in 300 word run-on sentences that no one ever understands; and nowhere is that more important than in drafting a lease.  Both parties must understand their rights and obligations in order to appraise the tenancy to insure that terms are met.  Additionally, leases are most often the single most important aspect of starting a new business and we work closely with entrepreneurial clients to make sure that the leases are adequate.  We have significant court experience in working out the unpleasant eviction proceedings and other litigation surrounding leases. 

Land Use
Land use issues can be complex and they include easements, zoning, right-of-way, planning and development.  We are committed to attentive representation that will speed up the process instead of bog it down.

Civil Litigation
From its inception in 2000, Allen, Wertz & Feldman, LLP, has maintained an active litigation presence in both state and federal court in Colorado.  We have successfully represented clients litigating and arbitrating disputes in all areas of practice that we are involved.  Our attorneys are members of and licensed to practice in state and federal courts in Colorado, New York and Pennsylvania, as well as the United States Supreme Court in Washington, D.C.  We are active members in the American and Colorado Trial Lawyers Associations.

Most of the time, litigation is not an enjoyable experience for our clients.  We strive to perfect a balance between aggressively litigating and negotiating a settlement that is financially beneficial regardless of an outcome at trial. 

We have experience in all forms of alternative dispute resolution, including arbitration and mediation, and our practice uses these forums when they are available and attractive.
